An Update

Hello everyone Helly here, just thought I would update everyone who has been reading this Blog about what has been going on since my last post.

Once the 'Boss' has realized I am really going to court over this (he must have got his summons in the mail is my guess) he has rung me once - This phone call he tried to "settle out of court" by offering to "put the insurance claims through and agree Kyle Bay Removals is liable", I refused this and stated I wanted cash for what the items are worth, and I was not going to pay the $400 odd premium for the insurance claim... and hung up. Since then he has been trying to call me numerous times, and my Lawyer has said not to answer. He has also left 3 voicemail messages.

We now have a definate number of 6 witnesses who can attend court, including the computer technician who fixed the equipment to show it could not have been damaged 'before' it was picked up, but rather whilst it was being picked up as the computer has an inbuilt time system as everyone knows, and the damage created caused this to stop.
We have a court date about 4 weeks from now, so will let everyone know what happens when it is over.

IF, and I say IF the Boss from Kyle Bay Removals leaves me a voicemail on my phone offering me the cash or replacement for all damaged items (and costs for the damage already fixed) I WILL drop the court case against him, if not we are in for a ride I am confident we are going to win.

Ongoing Drama...

"What an Ongoing Drama..."
Due to my career and personal life, I move house alot to be close to work and/or my children. Over the past 10 years I would say I have moved house 7 times, and I am suprised to say This has been the worst moving experience of my WHOLE LIFE! of moving house, bar none. I recently moved from Gymea, Sydney to the Sunshine Coast, QLD (Maroochydore) as I am a Systems Analyst (Large Company) I tend to move around a bit to different operations and company offices. Kyle Bay Removals was an outfit I picked out of the yellow pages, and what a mistake. To cut a long story short, they had broken over $2000 in computer equipment, and damaged furniture. They refused any such doing and had the nerve to say "This is how it was picked up". Luckily for me one of the computer items broken has the exact date and time it was last used, and COULD NOT have been used if in this damaged state - proving this statement is a flat-out Lie!.


This has been ongoing for about 6 weeks now, and I have filed a small claim court suit against the company. I have 7 witnesses on my defense who regularly seen my furniture (family) and tech equipment (work collegues). The thing that has made this so much of an ongoing drama, is not the court case, as we are confident for a win, but the endless hours spent arguing with the owner/manager who has no respect for customers property, and has been caught out in a number of lies since this all began. I feel sorry for other families that may not have the means to go to court against this company that just seems to be run by bullies.



I will keep everyone updated on what the outcome is in the courts, and just a warning to unsuspecting families.... KEEP AWAY! I had a feeling about this company when I saw their inexperienced looking website, and the 'thug' looking removalists working for them, but I ignored my gut and am now paying for it.
